I am writing this post not as a threat and not in some subtle way to infer something. I am writing this as a friendly reminder to our membership or for those who may not know. Story from C-NetIn a case that raises questions about online journalism and privacy rights, the U.S. Department of Justice sent a formal request to an independent news site ordering it to provide details of all reader visits on a certain day.
It instructed Clair to "include IP addresses, times, and any other identifying information," including e-mail addresses, physical addresses, registered accounts, and Indymedia readers' Social Security numbers, bank account numbers, credit card numbers, and so on.
We at the HPFF do not collect data on our members of the type or scope as was specified in the subpoena to this news site, but your IP address and email address do get recorded every time you login or visit the site. In addition we cannot claim some of the protections that the news site is entitled to as we are not and do not engage in journalism in any form. The 1st amendment and "freedom of speech" do not stand long in the face of a federal subpoena without the means with which to fight. I as the server admin or my host could receive something similar to this requesting whatever info we have, any time some fed thinks we should. I and my host would be bound by law to provide it. Not that the info we collect would amount to much for them, but still,... This is just a friendly reminder to our membership that what you say and do on the internet matters to someone. Some may not care, some may take offense and you never know who may be watching, or why they are interested. Practice common courtesy, practice discretion and never say anything on line that you would not want the world to hear you say. See attached copy of subpoena sent in this story. Some info, such as names and addresses, had been edited out before they posted it.

Naw, the DR can stay. We "regulate" the content in the DR only so far as to ensure compliance with our site rules, and/or anything widely known to be illegal. Anything else,... well, people have been warned.
If someone says or does something stupid, and I receive a subpoena, the aftermath will not be pretty. All I'm saying.

You really don't have to worry as much about the Fed Govt as you do of X-Wives and lawyers looking for stuff to use against you. There have been a number of cases already where evidence gathered from facebook was presented in court. I think the best thing to do is no use your real name and change you internet name every few years especially if you know you are heading into litigation.

well just a suggestion, expire and delete dark room content if the thread is idle for 30 days. Honestly most of the convos there are heat of the moment as stories /topics unfold on the web. No need to keep them around imo if subpoenas are being worried about. No need for archiving. Even though this was just a subtle way to infer something, my tin foil hat tells me to limit my activity imo. Also would be nice to give us the ability to delete our content after the expired editing period, that way you are not destroying "evidence". User submitted content, user deleted content. And yes, I tend to not say anything I would not repeat if asked also but things can surely be taken out of context very easily. Thanks for the heads up though ..appreciated

Just a thought on this: I believe this subpoena was for a SPECIFIC court case concerning possible illegal activity on the site or sites involved, and my understanding of the law and legal system in the USA (albeit not all-encompassing) is that the government will normally only "go after" someone or a group if they have actually broken a law and done something illegal that warrants such governmental attention. If you are just going about your normal business online and aren't participating in illegal activities, than you have no worries at all. Trust me, as much as we worry about the government and its intentions, they DO need SOME kind of power of enforcement to be able to gather the evidence that is required to prosecute ACTUAL criminals. Now, that DOES NOT mean that one should not remain vigilant in watching their government, for history has proven, time and again, that governments may will abuse their power if left unchecked. However, despite the road that this country appears to be walking, I doubt that we will have to worry about such abuse in such a broad scope in the the recent future...although, that could change... I'm not going any further on this, since anything else on this topic would probably have to be confined to the dark room. Mods/Admins, if this post is inappropriate, please feel free to either delete it or move it as necessary. I was not intentionally trying to post something inappropriate. Thanks!!! Jag

I agree with you normally, I'm just a little paranoid after the whole warrantless spying debacle under Bush. Granted, those folks probably had it coming too.
