I have a .40 jcp also. Check the tabs on the magazine, they may need to be adjusted. Also how old is the magazine?
I just bought a new mag and it seems to fit better than the one that came in the box.

I have Federal fmj's and have not any issues thus far...

Definitely federal, I've had Winchester whitebox fail to eject due to a inconsistent lip in the casing. Plus general rule DO NOT USE WHITEBOX AMMO!

Do you mean by "jams/ misfires" the gun not only jams but fails to fire chambered rounds? If this is the case you probably have a bad firing pin and or spring. I'd get a new ejector assy' and recoil spring and replace them at the same time. If the gun was used I'd always start with replacing these first.

Is this a pistol or carbine?

it jams and misfires... just bought a new magazine just now, it will puncture the back in put not set off(misfire), and jams like on the 3 rd shot and once more at the end of the magazine...
