Quote:
Fairfax, Va. The United States Court of Appeals for the Seventh Circuit ruled today that Illinois' total ban on carrying firearms for self-defense outside the home or business is unconstitutional. The case involves lead plaintiff Mary Shepard, an Illinois resident and a trained gun owner, who is licensed to carry a concealed handgun in both Utah and Florida. The National Rifle Association is funding this case. The Illinois State Rifle Association is a co-plaintiff in this case.

Boy, Obama is going to love this

Great news! So what happens next? Does Illinois put in place a concealed carry law similar to other states? Because as of right now, there is nothing, right? Citizens can carry because there is no law prohibiting it.

Nothing like a newfound good court precedent! This is good news!

Illinois now appeals the ruling... The judge stays any order pending the out come of the appeal.. Not sure what the legal arguments are in this case but if SCOTUS agrees to hear it then chances are they will up hold the lower courts ruling.... They the state will be forced to put into effect a set of rules granting CCW.. or at least granting people the ability to at least apply for a concealed carry permit.. Just like Kalifornistan... You can apply all you want.. nothing says they have to give you one..

There are still laws limiting who can legally own a firearm in Illinois. Open carry in a vehicle is prohbited in Ilinois.

See this and this for more info.

It's over, they lost. The state has 180 days to draft a CCW law and impliment it into affect.

Quote:
SPRINGFIELD - In a huge win for gun-rights groups, a federal appeals court in Chicago Tuesday tossed the state's ban on carrying concealed weapons and gave Illinois' Legislature 180 days to craft a law legalizing concealed carry.

"The debate is over. We won. And there will be a statewide carry law in 2013," said Todd Vandermyde, a lobbyist for the National Rifle Association.

Well, I guarantee the State will appeal to the SCOTUS like Bitsman said. Then it will be up to them to either hear the case and decide, or to not hear it, in which case this will stand.

Either way, they'll still probably have the strictest laws in the country

I wouldn't go out and buy a handgun just yet and think your going to CC in illinois soon. It will probably be harder to get a CC permit than even washington dc or nyc and it's hard to even guess what it may cost! The anti gunners won't give up easily.
