Default Injustice in W. Virginia!

I'm passing this along just as I saw it in another forum I belong to.It bears looking into as this is one thing all us CCW holder fear most,not just what happened,but the results of defending ourselves.The facebook page wasn't working when I tried to click it so it might have been taken down,I don't know.

Hey everybody! Sorry for the crosspost, but I want to alert all of you
to a situation that is going on here in West Virginia right now.
Yesterday or day before, a fellow named Jesus Canul (HAY soos Kuh NOOL
-- nicknamed "Jesse") from Logan, West Virginia, was coming out of the
Logan Walmart store when a fellow came up behind him and grabbed him
around the neck, threatening him with a pair of scissors at his throat.
Jesus has a concealed carry permit, and was carrying that day when he
was grabbed and robbed. He fought off the robber and shot him dead, and
now is being held in jail. He will apparently be charged with murder!

Our state's Castle Doctrine law says that anyone who is being threatened
has a right to use deadly force to defend himself or his property, which
is what Jesus was doing. However, the police are saying that the robber
had already let loose and was starting to walk away, so Jesus committed
murder. One of the authors of the Castle Doctrine has spoken with
Jesus, and says that it did not happen as the police are saying it did.
The tapes that Walmart's cameras made will show the truth, but they
have already been turned over to the police, apparently, and no one else
has seen them.

PLEASE be courteous, and don't come across as arrogant or nasty, but
please help by joining the Facebook group that's been set up, and let
others know about this miscarriage of justice! Please don't let him get
railroaded for something any of us would have done.

I feel for Jesse, however, if the BG was no longer a treat to Jesse because he already had the wallet and was leaving the area, then Jesse's Sh*t is in the wind. > I know how he feels, but that is a small part of the law that really stinks. If Jesse could of some have shot the BG while the sharp object was still at his throat then that would have been a good shoot.

A lot of assumptions on either side. If the cops are right and he was walking away, then it's murder. If the defendant is right and the attacker was still threatening him, regardless of whether or not he had let go of the defendant, then it's legitimate self defense. Right now we (water cooler quarterbacks) don't have enough information to say either way.

I look forward to the release of the security videos to prove one way or another.

Honestly in my opinion if someone is dumb enough to rob someone then it is the price to pay. Maybe it would stop crimes from happening down the road. Enough of this coddling the bad guys. Its time they start taking a little responsibility for their actions. I know the laws say differently and that is when common sense laws should be used.

gotta love the legal system here in the good ole USA! they are gonna try their best to put you in jail even tho you are in the right. why? its more revenue for them from taxpayers keeping you in there as long as they can than it is to access unnecessary court fees and appeals if you are acquitted ; plain and simple.. you are guilty until proven innocent here now which is not the way it was intended...

We need more people to shoot assailants. What would have happened if the guy let this perp go? He would have done the same thing again, either killed someone for the money in their pocket, or got arrested and become a burden to the tax payer for 25 years.

I could see knee capping the guy if he had been unarmed, but the guy had just threatened someone's life. We need to thin out the herd of these degenerates, maybe straighten out the gene pool a little.

You gotta shoot them up front and personal for it to be legal,not when they are turned in any other direction. Also..Lawyer up when LEO gets there,Ask to speak with the Lawyer BEFORE giving a statement to Anybody!. Just my 2cents.
