NY sues to dissolve the NRA - widespread fraud

    There actually have been several that have. When they were unable to make progress they resigned. Others have been shuffled out of key positions while still maintaining on the board. The board itself is packed and the ones who try to make change get punished. You just haven't heard about it.

    I posit that the NRA has historically compromised away more rights than they’ve protected.

    I don't think she has a case... not like we didn't know LaPierre was a scumbag out to line his pockets. He has been sued and forced to pay some of it back. This AG is not going to be able to try it, the NRA can show prior hostility in her campaign statements. She ran on taking down the NRA. This is already backfiring on the dems.

    She absolutely has a case. But I think she's way over-reaching for this. I think that will hinder it.

    So what? Politicians have run on "taking down" lots of organizations; everything from organized crime to Wall Street.

    It won't take them as far as they want. It will cost them some. But to call it "backfiring" is overstating it.

    The precedent set will be hellacious if this succeeds for the AG. There are plenty of other non-profits that will be vulnerable to the same kinds of attacks. I could see some Soros and Bloomberg non-profits being dissolved based on similar grounds if she is successful against the NRA. Of course, that would require the NY AG to go after the ones incorporated in NY. It's in the AG's purview to initiate the cases, based on what I've read so far. With that being said, I'm sure those high-speed ACLJ attornies could come up with a way to either force that or argue that the precedent set would open the door to future ideologically-based actions, further arguing that such an interpretation of the statute should not be carried as far as it has in this case. If she fails, the decision will be setting a new precedent, which would put some sort of limitation on how far an AG could carry the statute's interpretation.

    Unlikely. The AG chose the NRA for purely political reasons, not because the charges are true.

    See, that's the thing. Two things can be true at the same time. 1) The AG specifically targeted the NRA for political reason. 2) Wayne and his cronies are guilty of fraud, waste, and abuse.

    Wayne, AC-MAC, and many others top level specifically made the NRA vulnerable to the political machinations of the politically driven AG.

    Like I said, I haven't read the full range of cases where this statute underpinned the cause of action. Which case did you see setting a precedent allowing this interpretation of the statute?
    The statute does not allow a private right of action, but I would imagine that a good activist legal outfit could find a way to use a new and bad precedent to make life difficult for certain other non-profits.
    Aaarg! I had already calmed down after writing the same sentiments in my earlier post. Now I have to do some deep breathing.
     
  12. I think you're absolutely positively correct. Wayne needs to go into exile far far away and I would re-join the NRA if they moved out (they can't get Uhauls right now) and suddenly found honesty and salvation from their crimes. We can only hope.

    Do you really think Leticia is committing fraud? Or is it treason, extortion, a "hate crime", civil unrest, abuse of power, malingering, stupidity, ignorance, communism, some variant of it all or just plain all of the above? It's truly a gun rights believer (2A) disappointment to put it at it's mildest. May gun owners prevail.
