The guy that was charged with transferring a broken gun which happened to behave kind of like a machine gun under set conditions. And he was charged with that because they couldn't charge him with manufacturing a machine gun, because he didn't. This crap should have been tossed out before it even got started.

what hasnt been widely known is the fact Olofson had altered the weapon in question in a way that the BATF can construe was an attmept to make an illegal machine gun. In this particular the defendant screwed himself by messing with his weapon. they can sayabout anything they want to, to prove intent and in olofsons case, intent was key item that got him convicted.

His AR15 was not modified for the purpose of the charges. It was a pre 1986 Oylmpic arms that used mil-spec lower but no auto shear or provisions for one. These were found to have a problem if you rig the test with out of spec ammo(or you happen to run into some) and a recall was ordered. His was just never recalled because the transfer took place before the recall. No one has been allowed to examine the evidence but the ATF. Think on that a moment. No examination of evidence by the defense, none nada zero zilch. No presentation of the evidence for the defense to show how the ATF rigged the test. Court appointed council that had no experience with ATF or firearms, poor mans justice. Totally stacked deck.

second, when this trial first went down there was testimony posted on arfcom from the public record that he had altered the disconnector the ATF consideres that intent to build an illegal machine gun. since the ATF locked away teh evidence, this can neither be confirmed nor denied. being as the ATF had the only expert witness placed on teh stand, what else could the jury have construed from that action?
thirdly, if he was that poorly defended, why hasnt he filed an appeal based on improper representation by counsel?

He has taken every legal avenue open to him. SW I dont know what problem you have understanding the gravity of this case. No one can win under these conditions and the Supreme Court has sided with that condition.

my problem with teh JPFO is they are all too willing throw a non Jew under the bus to save thier own causes, and most discussions end up with them pulling out teh holocaust card to win an arguement. all their writers write from a biased point of view and dont allow room for the other side of the argument. to them being jewish is most important, and gun rights come second. if thats the way they want to be i dont have aproblem with it, but dont shout the idea that you are for the preservation of gun rights and then turn around and whisper "but only for the jews".
